By requesting a reservation, guests acknowledge and agree to abide by the listed rental terms and conditions and give permission to the property manager to use a third party for guest screening and identity verification to confirm the reservation. Terms regarding the guest verification process can be provided upon request. All required documents must be returned within 24 hours, or the reservation will be subject to cancellation. A signed rental agreement, government issued ID for identity verification, email address, and mailing address are required. Terms and conditions are accepted online at the time of booking. Non-signature of the agreement is not a release of any term or condition. Check-in instructions and access information will be provided 3 days before arrival (or within 3 days), provided all required information has been received. Please contact us with any questions. Short-Term Rental Agreement, Rules and Regulations, Terms of Service, Moose Management Vacation Rentals Park City. This Short-Term Rental Agreement (the "Agreement") is entered into by and between Vacation Rentals Park City, LLC, dba Moose Management Vacation Rentals Park City (the "Manager") and Guest (the "Guest" or "Primary Guest"). Guest and/or the plural form, Guests, refers to any person(s) entitled to use the Property, either as part of the Primary Guest's traveling group (including adults, minors, family members, or other co-guests) or by invitation of the Primary Guest or a member of that group. Guest's payment of rent and/or fees (partial or full), taking possession of the vacation rental property (the "Property"), or receipt of this agreement in any form is evidence of Guest's acceptance of this Agreement and all of its terms. The Primary Guest agrees to make all other Guests aware of these terms and is jointly and severally liable for their conduct.
Arrival time is 4:00 pm; departure time is 10:00 am. If the Property is ready before 4:00 pm, early check-in may be allowed; a fee may apply. Guest must call ahead to confirm the Property is ready and must not enter early without permission. Because ample time is needed to prepare the Property for the next rental, late check-outs are not permitted and are charged at $100 for each hour, or part thereof, past 10:00 am MT. Additional penalties may include added daily or nightly rental fees and/or lost revenue caused to Manager by the Property not being available for the next guests. If Guest plans to leave before the scheduled departure date, please notify Manager by phone or email.
No smoking: smoking is strictly forbidden in, or within 25 feet of, the rental Property. Guests must also comply with any smoking restrictions in or around common areas or facilities. Evidence of smoking (including e-cigarettes or vape pens) in or near the Property results in immediate eviction, forfeiture of all amounts paid, and additional cleaning fees charged to the credit card on file.
Pets: pets are prohibited in the rental Property unless otherwise approved by Manager in advance and in writing (this may apply to emotional support animals as well). Evidence of an unapproved pet may result in immediate eviction, forfeiture of all amounts paid, fines, and additional cleaning fees charged to the card on file. Pre-approved pet fees may not display correctly during initial booking. If a pet is accepted, the fee (covering hosting and pet cleaning) is added to the reservation: a nightly fee of $25 per pet, minimum $100 and maximum $350. For monthly stays, the fee is $450 for the first pet and $200 for each additional pet per month. A pet cleaning fee of $50 (2BR and under) to $100 (3BR and above) applies per stay. No pet charges apply if the pet is not approved. Please contact us with any questions or to add a pet to a reservation.
Service animals must be reported to Manager; an addendum with stay guidelines will be sent. As defined by the ADA, service dogs are individually trained to perform specific tasks for people with disabilities.
Use restrictions: no parties in or around the rental Property or in any common areas or facilities, and no gatherings beyond the registered number of guests. Rental of the Property is limited to family groups. The Primary Guest must be at least 25 years old, and Manager may require proof of age via a valid driver's license, passport, or other government photo ID. If the Primary Guest fails to meet this requirement, Manager may immediately evict all Guests with forfeiture of all payments made. The person signing the Agreement must be present during the rental period and is responsible for ensuring all other Guests and visitors comply with these terms.
Excessive noise: the Property may be located in a quiet residential neighborhood. Quiet time is 10:00 pm to 8:00 am, or as otherwise required by HOA rules available for review at the Property. Guest agrees not to undertake activities that violate this agreement or community rules, constitute a nuisance, or interfere with any neighbor's right to quiet enjoyment, and to comply with local noise regulations and use common sense in keeping noise low after dark. If Management staff must visit the Property to address a noise issue, a minimum charge of $100 applies. A follow-up complaint, or a visit by police, city representatives, or code compliance officials, results in an additional $1,500 Enforcement Fee and may result in immediate ejection or eviction without refund of any deposits or rents.
Arrival condition: the Property is inspected for cleanliness and, outside normal wear and tear, will be in good repair before Guest's arrival. Please report anything not in acceptable condition within 4 hours on the day of arrival. Anything not reported that day is deemed acceptable. Anything reported will be remedied if possible. If a remedy is provided, or a remedy is refused by Guest, refund requests will be denied. Manager may also refuse a refund request if there is evidence of fraud, refund abuse, or other manipulative behavior.
Travel insurance: there are no refunds of any kind for shortened stays, ruined expectations, or frustration of purpose due to weather or other unforeseen circumstances such as financial, health, or family emergencies. To protect the vacation investment, Manager recommends Safely Travel Insurance, which reimburses certain pre-paid, non-refundable expenses due to unforeseeable circumstances. Manager strongly recommends this coverage. By choosing not to include travel insurance, Guest agrees to bear all travel risks and assumes full responsibility for any resulting losses or additional expenses. Damage protection / guest verification: Guest agrees to be included in the damage protection plan required by Manager for the reservation. The non-refundable fee for this plan is included in the reservation total, and no credit or refund is issued for non-acceptance, as the plan is a mandatory condition of booking. The plan may be provided through Manager or a third-party provider selected by Manager, and its terms, conditions, and coverage are available on request. Guest also gives Manager permission to complete guest screening and identity verification through a third party to confirm the reservation and plan eligibility, and must provide a valid major credit card for items not covered by the plan. Participation in the plan does not relieve Guest of the obligation to leave the Property in the condition received.
Exclusions: the plan does not cover intentional or willful damage, gross negligence, theft, smoking, unauthorized pets, excessive trash removal, extensive or additional cleaning charges, unauthorized entry into excluded spaces, exceeding occupancy or parking limits, any violation of Manager's policies or this Agreement, or any violation of city, county, state, HOA, or other governing rules, and any resulting fines, penalties, expenses, or costs (collectively, "Excluded Damage Costs"). Excluded Damage Costs are charged immediately to Guest's credit card, and Guest is notified in writing.
Liability: the Property will be carefully inspected after Guest's departure. Any damage, theft, or similar incident not disclosed to Manager prior to departure remains Guest's responsibility to the extent not covered by the plan. Manager must file a police report before filing a claim for missing items. The plan does not cover loss of or damage to Guest's personal property; Guest should review the full plan terms rather than rely on this summary.
Conditions that must be met prior to departure, to avoid the accompanying fee or cost assessment: no items missing and no damage to the Property or its contents beyond normal wear and tear. No costs incurred from collection of rents or services rendered during the stay. Dirty dishes placed in the dishwasher and started. All food removed from the refrigerator and cabinets and disposed of (unopened, non-perishable, sealed food and paper products may be left if desired, consumed at the next Guest's own risk). All trash and debris placed in receptacles, not left sitting around the Property. If applicable, any garage remote or clubhouse key card returned. Used beds left unmade so housekeeping can determine use. Used towels and washcloths left on the bathroom floor or in the tub/shower. No HOA violation fines. Furniture not moved. Thermostat set to heat, 65 degrees, upon leaving, as pipes will freeze in winter months. No late check-out ($100 per hour or part thereof after 10:00 am MT). All doors and windows closed and locked. No parties or gatherings beyond the registered number of guests without prior written authorization (actual damages, $500 minimum charge). No holiday or party items left behind. If applicable, hot tub not left discolored from excessive use without showering ($100). No pet violation (minimum $500 fine plus actual additional cleaning and eviction costs). No smoking violation (actual damages, $500 minimum charge). No use of fireworks or other hazardous materials (actual damages, $100 minimum charge). No illegal activity (actual damages, $500 minimum charge). Guest is not evicted by Manager, the owner, or local law enforcement ($500 and no refund of rent paid). Any costs for conditions not met, including cleaning, repairs, replacements, and fines not covered by the damage protection plan, will be deducted from any security deposit, charged to the card on file, or billed to the primary Guest.
Payments: rates are set using dynamic pricing software and may be adjusted within 72 hours of booking if a review reveals a pricing discrepancy; Guest may proceed at the corrected rate or cancel without penalty. A summary of total payment due is provided with the reservation request and may change based on insurance, deposits, tax changes, or optional fees, discounts, or services. For reservations made through Airbnb, Booking.com, or another platform that collects payment at booking, payments are made and processed through that platform, and that platform's payment policies apply. Add-on services may be collected via credit card at Guest's discretion.
For all other reservations: a deposit of 10% of the total reservation is due at booking to reserve the Property. An advance payment of an additional 40% is due and auto-collected 30 days before arrival from the card on file. The balance of the remaining 50% is due and auto-collected 14 days before arrival. If booked within 30-15 days of arrival, an advance payment of 50% is collected at booking. The deposit and advance payment are not a security deposit and are applied toward total rental fees. Payment may be made by electronic check, Visa, MasterCard, Discover, or bank transfer; funds must clear before the arrival date. If Guest wishes to pay by a method other than the card on file, Manager must be notified before the respective due date. If all payments are not received 14 days before arrival, or within 24 hours if booked within 14 days of arrival, the reservation is subject to cancellation with no refund or credit of any payment made or due. Reservations made within 14 days of arrival must be paid in full within 24 hours of booking. All payments must be in U.S. funds.
Stays of 30 nights or longer: sales tax is not required for stays of 30 nights or longer. The damage insurance premium is adjusted based on stay length, with longer stays incurring higher premiums, and a monthly stay cleaning fee applies based on property size and length of stay to maintain cleanliness standards.
Cancellations: for reservations made through Airbnb, Booking, or Whimstay, that platform's posted cancellation policy applies. For all other reservations, 30 days' written notice is required. More than 30 days before check-in, the 10% deposit is due and non-refundable. Between 30 and 15 days before check-in, the advance deposit is due and non-refundable. Within 14 days of check-in, full payment is due and non-refundable. Manager may, at its discretion, permit Guest to move a reservation to another period of equal or longer length at the same rate with no penalty, evaluated case by case and only if requested more than 30 days before arrival; no guarantees are made. Early departure does not entitle Guest to any refund of rent or deposit. If Guest's stay becomes impossible for reasons outside Manager's control (including Force Majeure below), Manager may cancel the booking; Guest's exclusive remedy is a full refund of rent, cleaning fees, and any deposit paid, or, if the event occurs after check-in, a pro-rated refund of the unused period.
Maximum occupancy must be strictly followed; if exceeded, all Guests may be required to vacate and forfeit all rental payments. A request for additional guests must be made to Manager in writing at least 3 days before check-in and may be denied at Manager's discretion (no response constitutes denial); no approved additional guest may remain past 10:00 pm. Guest is responsible for ensuring all other Guests and visitors know and abide by these terms.
Guest will not assign this agreement or sublet any portion of the Property.
Stay requirements: minimum stays are required and vary by property and season; one-night stays are not permitted. This is a short-term rental with no right to occupancy beyond the booked dates. Stays under 30 consecutive days are managed by Manager; stays of 30 or more consecutive days are managed in partnership with Advantage Management and Real Estate Services LLC and may require a separate lease. Any breach during the stay may result in ejection or eviction without prior notice or opportunity to cure, and without refund of any deposits or rents.
Inclusive fees: rates include a one-time linen and towel setup, plus an initial supply of paper towels, toilet paper, trash bags, and dishwasher detergent, not replenished during the stay. Additional sundries are the Guest's responsibility, and any other incidental supplies at the Property are not promised or guaranteed.
Housekeeping services: the Property is professionally cleaned prior to arrival. Daily maid service is not included, though a mid-stay cleaning may be requested for a fee, subject to availability. Manager's obligation is to provide a Property meeting professional short-term rental cleaning standards. Guest must report any deficiency in writing with photographic evidence within 4 hours of check-in via email or text. Reports to onsite staff or third-party vendors are not official notice, and reporting grants Manager immediate permission to enter to inspect and remediate within a 24-hour cure period. Refunds or credits are not issued if access is denied, if the issue is resolved within 24 hours, or for normal wear and tear consistent with a high-traffic rental, including minor cosmetic imperfections that do not impair function or pose a documented health or safety risk. Manager's assessment of what is clean and functional, and of any health or safety risk, is final and binding. Manager's maximum liability for any unresolved cleanliness issue is limited to a refund of up to the cleaning fee paid. Any credit issued and accepted is a full and final settlement, waiving Guest's right to further claims or chargebacks. Housekeeping arrives promptly at check-out. Belongings left behind may be moved to storage at Guest's risk for a $500 service fee. Guest agrees to hold Manager and its contracted vendors or employees harmless from legal action related to this process.
Maintenance and damage: Manager strives to keep all facilities in good repair. Guest must report maintenance concerns in writing with photographic evidence within 4 hours of arrival, or immediately upon discovery, via email or text. Reporting an issue authorizes Manager or its contractors to enter and perform repairs. Manager will make good faith efforts to resolve reported items within 24 hours but is not liable for delays due to parts availability or third-party providers. No refund is given for malfunction of non-essential items, including Wi-Fi, cable or streaming services, pools, hot tubs, or kitchen appliances, nor for normal wear and tear or minor cosmetic imperfections that do not impair function or pose a documented health or safety risk. Manager's determination of functionality and of any health or safety issue is final. Manager is not responsible for service interruptions caused by weather or third-party utility providers. The Property is in a mountain environment where insects and rodents are native. Pest control is maintained, but occasional encounters are not a breach of service or a safety risk, and no refund is given for the presence of native wildlife or insects. Failure to report an issue through official channels, or denying access for repair, waives Guest's right to a refund or chargeback. Guest's sole and exclusive remedy for any unresolved maintenance failure is a credit of up to 10% of the daily rental rate for the specific dates documented. Any credit issued and accepted is a full and final settlement, waiving Guest's right to pursue further claims or chargebacks.
Entry, inspection, and ejection or eviction: the owner, Manager, and their vendors or employees reserve the right to access the Property for emergencies, agreed repairs, alterations, improvements, or services, showings to prospective buyers, guests, workers, or contractors, condition inspections, situations where Guest has abandoned or vacated the Property, and ejection or eviction for breach of contract. Manager will make reasonable efforts to notify Guest in advance, though prior notice is not required, particularly where immediate access is necessary, and Guest's objection does not bar entry.
During any stay under 30 nights, all Guests must vacate the Property within 60 minutes of Manager's arrival and verbal notice of ejection. If Guests are present, up to 60 minutes is allowed to remove personal property; if not removed in that time, Manager will photograph, inventory, and store the property, and additional charges beyond the ejection fee may apply for its removal. The Primary Guest must claim stored property within 30 days or it will be sold or donated. If any guest does not immediately comply with a verbal notice of ejection, Manager will call for law enforcement assistance, and Guest will be charged the $1,500 Enforcement Fee.
During any stay of 30 or more nights, all Guests must vacate within three calendar days of a notice to quit or vacate; if not, the owner, Manager, or Advantage will file an unlawful detainer action, and, in addition to other fees and costs, Guest may be liable for up to three times the value of the rent and damages allowable under Utah law.
Holiday and party decorations: Guests may decorate for special occasions at their own expense but must remove and dispose of decorations prior to departure. Christmas trees may not be left behind, as the trash company will not collect them; a $50-$200 disposal fee applies for items left by Guests.
Personal belongings: Manager and its vendors or employees are not responsible for lost personal belongings or valuables during or after the stay. If Guest notifies Manager of a missing item within 14 days of departure, Manager will make reasonable efforts to return it; unclaimed items after 14 days will be donated to a local charity. A $25 fee plus shipping covers labor, drive time, and postage. Owners' locked closets are private, not included in the rental, and are not to be opened or accessed by Guests under any circumstances, even if found unlocked.
Parking: the Property may be subject to parking rules or policies adopted by local government or the HOA, and Guest is expected to know and comply with them. Guest should not park trailers or recreational vehicles at or near the Property without Manager's prior written permission. Neither Manager nor the owner assumes liability for damage or costs from any vehicle, trailer, or recreational vehicle parked at or near the Property or towed.
Until a reservation is accepted and a deposit received, rates are subject to change without notice. Any reservation obtained under false pretense is subject to forfeiture of all advance payment, deposit, and rental money, and Guest will not be permitted to check in; if falsified information is discovered after check-in, Guest may be evicted with no refund of rent.
Storm policy / road conditions: no refunds are given for storms or other weather or road conditions. If the stay is during winter months, please come prepared to drive in snow and ice to reach the Property.
Force majeure / act of God: the owner, Manager, and their vendors or employees are not liable for any default or delay in performance caused by events beyond their reasonable control, including acts of God, riots, floods, washouts, explosions, earthquakes, fire, storms, acts of a public enemy, governmental acts or omissions, wars, insurrections, civil disorders, quarantine restrictions, epidemics, or pandemics.
Frustration of purpose: the sole purpose of this Agreement is to provide lodging during Guest's stay. Unavailability or inaccessibility of amenities, services, facilities, or other third-party offerings not controlled by the owner or Manager does not excuse performance of this Agreement, and such offerings are not considered an essential term.
Winter conditions: this Property is in a mountain location where winter conditions may apply. Walkways, driveways, sidewalks, and stairs may be slippery from ice and snow, even when they do not appear to be; please use caution and step carefully on all outdoor surfaces, and remove wet or icy shoes upon entering, as they can cause slippery conditions on tile or wood floors indoors.
Clubhouse (if applicable to the home): a clubhouse key card is located inside the Property; a $200 replacement fee applies if not returned upon departure. Guest agrees to abide by all posted clubhouse rules and regulations, which include video surveillance of activity, and is responsible for repair costs from damage caused by their group.
The Property (and any common areas or facilities) may include Special Amenities such as private or shared spas, hot tubs, whirlpools, saunas, or pools. These are luxury amenities not guaranteed to be available or functioning during the stay. Guests must comply with all rules governing Special Amenities, such as hours of use, noise restrictions, maximum users, food consumption, or glass containers; violations may result in a ban from further use.
Hot tub (if applicable to the Property): children under 12 are not permitted in the hot tub without direct adult supervision. Please shower before use, as excess body oils and lotions can cause the water to become cloudy, foamy, or discolored and reduce filter efficiency. A $100 fee applies to drain and refill a hot tub left discolored from use without showering. There are certain health risks associated with hot tub use. Use at your own risk. Do not press more than one function button at a time, as this can affect programming and stop heating or filtering. A $25 fee ($50 after hours) applies if maintenance is called for user error. The hot tub is drained, refilled, and chemically balanced on a regular basis by a certified pool operator, and a licensed technician may enter to service it regardless of occupancy, as county licensing may require a drain and refill if water cannot be balanced. After a refill, the water takes 12-24 hours to reheat. Hot tub covers are for insulation only and are not designed to support a person. Do not stand or climb on the cover. When not in use, please leave the cover on and cable locked for safety.
BBQ / fireplace / fire pit / patio heater (if applicable to the Property): Guest must ensure burners and any propane or gas are turned off when not in use. If a propane tank is provided, it is a courtesy; Manager does not monitor levels or make exchanges, though reimbursement for refills can be obtained by sending a receipt to Moose Management. Any damage caused by fire or smoke is Guest's sole responsibility.
Bicycles (if applicable to the Property): use of bicycles left at the Property constitutes agreement to the following. Insurance: Guest is responsible for their own travel, health, and dental insurance to cover any accident, injury, or third-party liability arising from bicycle use; no coverage is provided by Manager for loss, damage, theft, or other liability. Use of bicycle: Guest voluntarily participates in an activity with inherent risks and assumes all risks of bicycle use, including poorly maintained roads and other hazards, and agrees to operate the bicycle safely for prevailing conditions, including wearing a helmet, knowing and following relevant road rules, having relevant experience, and riding only during daylight, as bicycles are not equipped with lights for nighttime riding. Release of liability: Guest, for themselves and anyone they are legally responsible for, releases, discharges, and holds harmless the owner, Manager, and their agents and employees from all liability, harm, or damage related to bicycle use in connection with the rental, understands that bicycles and related equipment are not regularly inspected and no warranty is made as to their condition, and assumes the risk of any inadequacy. If a bicycle user is under 18, the Guest represents that they are the parent or guardian and consents on the minor's behalf.
Special rules and regulations (if applicable to the Property): the Property may have specific rules posted at the Property, listed in guest materials, sent by email, or communicated by phone. Guests must comply with any such rules; failure to do so may result in restricted use, fines, or eviction without refund of rents.
No illegal acts: Guest will comply with all applicable municipal, state, and federal laws and HOA rules regarding use of the Property, and will treat the Property with respect. Some neighbors are guests and some are permanent residents; Guest must respect their peace and privacy at all times. Violations may result in eviction without notice and without refund of any deposits or rents, and evidence of illegal or disrespectful activity may result in a minimum $500 fine.
Waiver: failure of the owner or Manager to enforce any provision of this Agreement does not waive future enforcement of that or any other provision.
Legal: Manager and Guest agree to mediate any dispute arising from this Agreement before resorting to court action, unless the amount in controversy is within the jurisdiction of Small Claims Court in Summit County, Utah, in which case mediation is not required before filing there. Mediation costs are shared equally. This Agreement is governed by Utah law; in any action arising from this Agreement, the prevailing party is entitled to attorney fees, costs, and expert and consultant fees. Notwithstanding the foregoing, the owner, Manager, or Advantage may eject or evict Guest, or have Guest removed by law enforcement or legal proceedings, for any alleged violation of this Agreement without being required to mediate.
Privacy policy: Guests using our website or management services agree to our privacy policy posted on our website.
Credit card(s): any Guest who provides credit card information does so as a guarantee of payment of the rental fees and accepts full liability for those fees, including any related costs or charges under this Agreement, as well as any damage not covered by the damage protection plan, during that Guest's occupancy and use of the Property, and authorizes Manager to charge the card for such fees.
Waiver and release of all claims, assumption of risk, and indemnification: Guest agrees to carefully read this waiver, release, assumption of risk, and indemnity provision (the "Release"). Scope: this Release applies to use of the Property by Guest, co-Guests, visitors, or other authorized users, including the Property's interior, exterior, fixtures, appliances, heating and cooling systems, structures, common areas, facilities, amenities, stairways, yard areas, barbecues, fireplaces, swimming pools, hot tubs, and bicycles, and any other amenity of the Property or community (collectively, "Use of Premises"). Releasing parties are all Guests, co-Guests, visitors, or other persons on the Property during the stay, invited or not, including family members and minor children. Released parties are Manager, the owner(s) of the Property, and their employees, representatives, agents, vendors, contractors, assignees, volunteers, and others acting on their behalf.
Risk of use: Guest recognizes there are inherent risks in the Use of the Premises and any pool, hot tub, or bicycle use, including risks of property damage and personal injury up to serious bodily injury, permanent disability, paralysis, or death, which may be caused by Guest's own actions, the actions of co-Guests, visitors, or third parties, property conditions, weather, or the negligence of the released parties, including risks from unfamiliar or defective stairs, decks, furniture, windows, doors, fireplaces, grills, appliances, heating systems, and landscaping, unfamiliar or poor lighting, loose fixtures, slippery or uneven surfaces, electrical systems, sharp or heavy or hot or cold objects, items within reach of children, weather-related hazards, and the general age, condition, or location of the Property, as well as risks specific to pool or hot tub use (including drowning, slippery surfaces, or diving) and bicycle use (including malfunctioning equipment, collisions, or unsafe road or weather conditions).
Assumption of risk: Guest and all releasing parties knowingly and freely assume the risk and liability of any Use of the Premises and of any injury, death, or property damage from any cause, foreseeable or not, resulting from the use, occupancy, or enjoyment of the Property, even where caused in whole or part by the negligence of the released parties, and certify that they have adequate insurance to cover any injury, illness, or damage that may occur, agreeing to personally bear losses associated with such damage or injury. Guest warrants that all minors will be properly supervised, monitored, and controlled at all times to prevent injury, death, or property damage.
Release of liability: in exchange for being allowed to use the Property, including any pool, hot tub, or bicycle equipment, Guest, on behalf of itself and the other releasing parties including minor children, waives, releases, and gives up the right to hold the released parties liable for any injury, loss, or damage suffered while using the Property or during the stay, including all accidents, injuries, illness, damages, or losses regardless of severity, including death or disability, whether or not caused by the negligence of Guest, other releasing parties, or otherwise, and agrees that the released parties are not responsible for any accident, injury, illness, loss, or damage sustained during Use of the Premises, including that caused in whole or part by the negligence of the released parties. This Release fully and completely discharges, waives, and forever relinquishes any claims, demands, or causes of action against the released parties related to the Use of the Premises and the Property.
Indemnification: Guest agrees to indemnify and hold harmless the released parties from all damages, injuries, claims, costs, and expenses related to acts, events, or omissions occurring in, on, or about the Property, or arising from Use of the Premises, Guest's breach of this Agreement, or any work or activity done, permitted, or suffered by Guest on the Property, even if caused by the negligence of the released parties, including the released parties' actual attorney fees, with each released party entitled to counsel of its choosing. This obligation applies to any claims related to Use of the Premises, including claims by releasing parties against released parties for injury, death, or property damage or loss.
Mold, mildew, meth contamination: Guest agrees to defend, indemnify, and hold the owner harmless against all claims, actions, demands, liabilities, losses, damages, and expenses, including attorney fees and court costs, arising from the growth of mold or mildew, or methamphetamine contamination, caused by the actions or negligence of Guest or any invitee or occupant of the Property, and agrees that the released parties are not liable for any resulting damage to Guest, Guest's invitees, occupants, or their property, regardless of the source of the contamination. Guest agrees to notify Manager or Advantage immediately upon discovering any mold, mildew, or contamination at the Property.
Acknowledgement: this Release is intended to be as broad and inclusive as permitted by law, and no oral statements or representations apart from this Release and Agreement have been made. Guest acknowledges reading and understanding this Release, and understands it applies not only to Manager but to all released parties, including the owner(s) of the Property, and binds Guest and Guest's spouse, heirs, personal representatives, assigns, visitors, authorized users, and minor children. Guest understands this is a legal agreement giving up substantial rights on behalf of themselves and their minor children, and declares this Release is signed freely, completely, and unconditionally.
Entire agreement: the foregoing is the entire agreement between the parties and may be modified only in writing signed by all parties. Each section, subsection, paragraph, or sentence is severable; if any portion is unenforceable, the remainder remains valid. This Agreement, including copies or facsimiles, may be signed in counterparts, each an original, together constituting one instrument. If there is more than one Guest, all Guests are jointly and severally liable under this Agreement.
By placing a reservation, all terms and conditions of this agreement are deemed read, understood, and accepted, and receipt of this information is acknowledged.
